#消息# 【开发者再次输掉GitHub Copilot版权案】据Techzine 7月9日报道，美国法官再次未能在针对GitHub Copilot涉嫌版权滥用的集体诉讼中为开发者平反。根据法官的说法，诉讼称微软开源存储库环境的AI工具生成的代码与开发者的不一致。 2022年11月，代码开发者在GitHub Copilot AI代码工具推出后，对GitHub和微软提起了22起诉讼。这是因为诉讼相关的代码开发者可能存在版权侵权行为。 具体来说，这个AI工具据称是在GitHub上的开源软件上训练的。该工具创建的代码片段并未遵守任何许可证，也没有注明原始开发者。基于此，开发者认为这侵犯了他们的版权，将其告上法庭。 之后，许多指控被驳回，现在美国法官再次或多或少地驳回了最后的这些投诉。法官在最新裁决中的主要论点是，GitHub Copilot生成的代码与代码开发者添加到平台上的代码并不完全相同。 据称GitHub去年修改了其AI编程助手，以呈现训练代码的轻微变体，防止开发者提出版权主张。此外，法院不认为GitHub的工具违反了数字千年版权法（DMCA）。这一决定是因为该平台采取了额外步骤来保护版权。例如，它删除了所有许可和开发者数据。法官认为原告无法（充分）证明这一点，因此立即驳回了这项诉求。 法官驳回的另外两项诉求涉及GitHub和微软不当得利以及损害评估。诉讼中还有两个案件仍在进行。一个涉及侵犯开源许可的投诉，另一个涉及违约。后一个案件在早期阶段被撤销后又被重新提起。 （编译：聆丰）链接：网页链接
